It's not the government that actioned the hoop - it's the homeowner's association, which is a non-governmental entity and therefore does not need to obey due process in its internal workings. lol Aestu. Why don't you bother to actually read up on things before commenting -- or at the very least watch the video? It was DelDOT (Delware Department of Transportation), a government entity, that removed the hoop because it violated a law. An anonymous resident complained which lead to the government taking action. Hence, if you had watched the video, you would see that they brought a STATE trooper to enforce the law by threatening to arrest them if they didn't let them take the hoop.

A woman climbed up and sat on top of the basketball hoop in front of her house in a faceoff with a bulldozer sent by the the Delaware Department of Transportation (DelDOT) to rip it out.

DelDOT said the hoops violated Delaware's "Clear Zone" law, which prohibits trees, shrubs, hoops and other objects from being within seven feet of the edge of the pavement in subdivisions.

That's the state government, not a homeowners association.

DelDOT sent the bulldozers, Delaware made the law, Delaware sent a state trooper to enforce the law - how does this not make the state the entity that is actioning the hoop?

Wait, don't answer that.

You're absolutely right Aestu. My mistake.

The contact for reporting a hoop is specifically listed under contact information for homeowners' associations. The entire point is that these organizations are out of control and having laws tailored for their benefit. If you don't live in this sort of bizarre feudal setting, the law doesn't apply. Homeowners' association makes the call, contractually they have the right to do as they please, cops enforce their findings.

Indeed, I am right. It would have been sufficient to ask why or do a bit of research on your own about what the deal is with basketball hoops being reported. I have confidence in my judgement for good reason.

Aestu, I'm not sure why you had to underline 'subdivision.' A subdivision isn't the same as an HOA. A subdivision is the same as a neighborhood and that neighborhood/subdivision may, or may not, have an HOA. The HOA has rules which members must follow and the HOA rules don't supersede state and local laws. The basketball hoops were violating a law Delaware has in place which pertains to subdivisions. The person that narked is irrelevant to the story. Your underlining of 'subdivision' in hopes to say it's the same as an HOA is wrong.

The placement of the hoops were violating a law.
The state came in to police the situation.
The hoops were removed.

Seems pretty simple to me although I don't agree with the law or the action. I also dislike how the officer said they would get to keep their basketball hoop then didn't honor that statement minutes later.

Edit: Actually, I do agree with the law. If states didn't have that law then anyone could install any fixture on state property which could impede traffic... especially emergency vehicles like firetrucks.

The basketball hoop dilemma happened to us when I was around 14 or 15. We had to move the hoop and since we had a very steep driveway we never really played basketball again :/ We played all the time previously.

I'm sure the law has it's reasons but I just know from personal experience that it sucked not being able to shoot hoops on a flat surface anymore.

I see, thanks for the clarification. Still, it's a retarded law. I don't buy the emergency vehicle argument.

Then the law should specify that such objects are fine until the impede emergency/state vehicles from performing their duties. If that goal was in front of a fire hydrant, by all means make them move it. Other than that it's just a law put in place so pussy whiners can whine and other people can lick their asshole and say shit like "It's a law, it must be right!" Next week their is gonna be a law that allows any agent of the government the right to enter your premise just for suspecting you did s......... Nevermind that already happened.

If they were in violation and had to come down, that's all well and good, but it seems like some people missed a lot of due process concerns, like responding to the responses to the notification that those items were going to be removed. It was also pretty over-the-top to tell the guy he could keep the hoop/post, and then go "ha-ha, fuck you" and roll out with it, which wasn't nearly as fucked up as that rancid cunt telling those people they had to go in their house. Fuck that stupid whore, I hope she followed the truck back to DelDOT and the fucking hoop bounced out, smashed through her windshield, and crushed her useless, empty, self-important skull.
