Well... for starters are the two types of laws the same? If they're not, it would seem that the arguement is a bit non sequitur. I'm not saying you're wrong for questioning the laws, just that the laws you used might be too different to look at through such black and white lens. Surely, intent isn't the only element of a crime that is considered when a law gets made.

The idea of a hate crime is asinine.

Also, the quote goes "There's nothing more permanent than a temporary government program.".

The idea behind hate crime laws is to punish mindsets. If you attack/kill people for things they can't control, you deserve to be in the slammer for longer.
