If the recruitment guy, on his own authority, offers him ten million dollars, he's personally liable for ten million dollars when the terms of the contract are met. As for the second hypothetical, I'd have to guess about the amount of discretion a recruiter is allowed to exercise. On the basis that the recruiter isn't the only person to see a potential recruit's file, I doubt he's ever in a position to make that decision.
