law student opinion please.

Man allegedly drives his car to his uncles house. gets out and shoots the dog. aunt and uncle come out yelling at him. he shoots and wounds the uncle and the aunt. the dog dies. the suspect runs away. Couple calls 911, says who did it, where he lives etc. Cops go get the guy. In the court room, aunt and uncle both positively identify the man in court. ballistics match up with the three bullets to the gun owned and registered to the suspect.

I'm not sure what the official charges were. Assault with a deadly weapon at least, but that's irrelevant.

all but one of the jurors said guilty. one, an old woman, would not commit to guilty verdict no matter what anyone told her. Result was a hung jury, the accused went free.

How pissed would you be if you were the prosecutor?

A hung jury should result in a mistrial, unless the presiding judge is a fucking moron. This means we can retry him, and he's only free until we get the wheels turning again.

If the presiding judge is a fucking moron, I'd be pissed that I (or my team) hadn't peremptorily challenged (and thus disqualified) the old woman from sitting in the jury.

If destruction exists, we must destroy everything.

Maybe for you Commonwealth people, but in America, jury verdicts have to be unanimous.
