I'm not opposed to gay marriage, but I'm hoping the court stands out of the way and leaves it to the democratic process. We don't need another Roe v. Wade type decision that's going to leave decades of hate and discontent in its wake.

And in my fantasyland where we stop pretending it's the 18th century, the Court shits on states' rights and makes federal rulings binding on all parties. The only decision that leaves "hate and discontent in its wake" is the decision that doesn't support gay marriage.

P.S. Roe v. Wade was 7-2, or had you forgotten?

If you want my prediction, Roberts is gonna do what he did in the Obamacare decision: he's gonna realize which way the wind is blowing, conclude he wants to be remembered fondly, assign the case to himself, and write a somewhat less-inclusive and more caveat-filled majority opinion than, say, Ginsburg might have.

People can go fuck themselves if they want to deny people equal rights because they think gay sex is gross. I'd be willing to bet money that there'd still be segregation in the deep south if we left civil rights to the democratic process.

That's missing the point. Having the court make it legal with the stroke of a pen is only going to give legitimacy to anyone who opposes it on the grounds that it wasn't passed legislatively. With the pendulum swinging toward the ballot box/state legislatures passing law to validate marriage for homosexual couples, there's no compelling reason not to exercise restraint.

That's fine. People can whine about it not being legitimate while the rest of America (read: the parts that aren't ass-backwards bigots) will celebrate the fact that two consenting adults, regardless of sexual orientation, can get married and enjoy the same benefits and opportunities as straight couples do under the law.

Quite frankly I think "marriage" needs to be done away with completely in the legal system. Call them all civil unions and let any two consenting adults get them.

Considering that marriage is a private contract between two consenting adults, I don't think the government should have ever gotten involved with straight marriages, much less any others.

But they are and they have been for a long time now. It's unfortunate, but the supreme court is the way to go in this particular subject.

spousal benefits, like power of attorney? can have power of attorney given to a non "spouse." My brother has mine. Write that into the marriage contract.

I've never understood the reasons for the tax code changes to changes in marital status, and I don't believe there should be any.
