technically, you can circumvent this law by stating clearly, and immediately, "i am taping this" (and you do inherently have video taped proof that you did).

the law hinges on it being without their consent.

there have been (i'm sure rare) cases where a cop pulling this shit got it thrown out of court because the person was standing there pointing a camcorder at them and the cop had absolutely no way to claim he was unaware what was happening, and implied his consent by not asking the person to stop.
