Was on Slashdot last week. Apparently they came calling and asked for their tracker back after telling the dude he wasn't interesting enough to spy on.

Kinda torn on this. On the one hand it's pretty abhorrent. But on the other it's like... what use is even having a government and spies if they can't spy? You take away this, then where's their power? Kinda defeats the purpose of them existing.

Spies exist to work against foreign enemies.

Domestic enemies generally are citizens and are protected by the constitution. Thats why this is wrong.

if the guy was illegal, fuck him.

Well, yeah, you'd totally ruin an op with that kind of placement. If you're placing an asset like that for long-term intel gathering, your first consideration is going to be making sure the placement will be secure for the duration of your op. Placing the asset so that it isn't discovered by your subject, however, is equally important, and anyone who would have placed it where it could be discovered and/or identified during basic maintenance obviously didn't know what they were doing.

Not that I have a passing knowledge of that sort of thing...

This will probably not have any sort of legal impact. It looks like a case could be made that this sort of surveillance could be made by other means, and the only real difference is one of efficiency. Hopefully, though, the courts will rule that such surveillance should be made only under extraordinary conditions, and not just spammed on guys with funny Arab names (among others). Assets like that shouldn't be placed until it's determined that the subject warrants that sort of attention...it shouldn't be placed, as it seems to have been in this case, to determine whether or not the subject merits the attention.

Oh, and Yahoo! was weeks behind on this one. I'm pretty sure Helig showed me this one a few weeks back.
