I think we can all at the very least, regardless of political position, agree that it was foolish (if not deservedly career-ending) for Rep. Anthony Weiner to get caught with his pants down the way he did. What I'd like, now, are some thoughts on this clown McGee.

For those of you who don't know, John McGee is an Idaho senator, and he was arrested on June 19th for grand theft auto and drunken driving. Seeing as the not-quite-illegal act of sending pictures of your dick to people is grounds for forced resignation, how do you think a felony and a misdemeanor should be handled?

It's funny...I was reading an article the other day about all the sorts of issues other politicians have had that are way worse than tweeting a dick pic and they weren't encouraged/asked to resign.

I wish I could find it again...because it was really funny.

More of a rant about drunk driving but I think it is severely under-punished in many states (based on my somewhat limited experience/knowledge).

"Any person caught drunk driving will have their car flipped over and burned by rioters" probably does deter drunk driving.

It's more like:

If caught imparied and driving licence removed

If involved in an accident the person impaired is at fault always

If involved in an accident involving death the person impaired is at fault and faces life in prison.

Don't drink and drive

I just did a google search of it but it seems like the main way it is more "strict" is that it penalizes those who are in the driver's seat of a car regardless of whether or not they are driving. Aside from that 1 year suspended license and minimum $600.00 fine doesn't seem like that much (While this is the minimum I still feel that it should be higher 1-2 year suspended license and 2K fine or a 1-2 weeks in jail).

The fact that you can be arrested just for being in the driver's seat drunk sounds like some legal technicalities that were brought about due to some prior loophole.

Anyway, I thought you can get in trouble in the US for a similar situation. Like, if I get in my car, and have the keys in it and i'm in the drivers seat...even if im in park...im still drunk and behind the wheel.

I know one of my buddies got bitched out by a cop but didnt get in trouble when he was drunk and sitting in his seat sleeping...but he had thrown his keys to the opposite side of the dashboard, so he clearly wasn't trying to drive home.

The blood alcohol amount to be considered over the limit (I could have worded that better) is also very low here.

If you're 21 and under you have to drive with 0%

The amount for "major" charges is 0.08 but anything above 0.05 can get you lesser charges.

In America, road regulations are state-specific.

In California at least, it works pretty much as you describe. Enforcement is less than perfect.

Absolutely should be forced to resign. I think the limit here in Virginia is .08 as well but I have read that we are one of the more strict states. I agree that if the keys are in the ignition you should be charged with drunk driving but if they keys aren't even in I don't agree. Although I think now some cars don't need to put the keys in the ignition? Maybe this is just to cover those.

As for drunk driving...

My grandmother was killed in an accident caused by a drunk driver.
My youngest brother nearly lost his leg after he was struck by an intoxicated driver.

Even given that, I think our drunk driving laws are seriously out-of-whack. .08 doesn't represent a lot of alcohol. I figured it up one night, and for me it's the two beers I might have with a steak dinner. Am I too drunk to operate a vehicle after two beers? Honestly? "Well, it yada yada yada..." Blow me. It's ridiculous, and you know it.

I had a friend in FL who had been convicted of SEVEN DUIs. He didn't stop, and because he could plead hardship due to his work, he usually had his license back in around six months. You expect me to believe they give a damn about drunk driving when they're giving a repeat offender his license back AT ALL? They're not, because it's not about keeping dangerous drunks off the road.

So why are these laws the way they are? First off...SENSATIONALIST MEDIA+MOMMY GROUPS, the vengeful harpy lobby gives those media outlets something to fill the dead air. Secondly, MONEY: not only does the state collect a lot of cash in the form of fines and court costs, but the bar rakes it in (ever notice how many politicians are lawyers?), as do the insurance companies. And it never makes the problem go away, because our system isn't about making the problem go away, it's about the squeaky bitch(es) getting the grease and motherfuckers getting paid.

You want to treat it seriously? Do away with the .08 crap. Put the bar back at .10, where reflexes, reaction time, and motor control become impaired...at least for 'driving while intoxicated.' I have no issue with issuing a 'driving while impaired' for anything beneath that so long as it is in conjunction with a moving violation of some type. The 'keys in the ignition' shit needs to go to, it's just a ploy to widen the net to pull in more money...if the car isn't running, it's not driving. Lastly, if we're going to take this seriously, we can't be giving repeat offenders their license back...especially not after a brief period of time.

I'm not sure which state you're refering to, but in Ontario (go Canada!) you'd lose your licence for life on the third conviction >0.08
