Justice Roberts gets a free pass on any opinion he issues for the next three months. I don't care how asinine they are, he's earned himself that much.

In case anyone's curious, the Supreme Court just ruled 5-4 that the Affordable Care Act is constitutional. What's surprising is that the 5th vote was not Kennedy (or Scalia, if he'd shown any fucking consistency with his Raich opinion), but Roberts.

One of many articles on point.

Credit where it's due, he didn't vote on party lines and I hear he specifically stated that his job is to judge the constitutionality of a law, not its merit. The man did his job properly, imo.

Every judge says that, they just tend not to mean it.

I am pleased he chose this particular case to do the job right, all the same.

It's hard to see what's left of federalism.

Didn't they vote that it is a "tax" ? And doesn't that just mean that they don't have to vote(make a real decision) on it until such a time as someone actually files a claim for loss due to an unconstitutional tax(so 2014-15) ?

I will start off by saying I probably look at this from a different point of view than a lot of people because I am self employed(currently under employed >.>) and I don't really feel the need to get health insurance(I'm both young and fit). Even if I did I would not be able to cover the costs. But for shits and giggles lets say I'm a Bill Gates and I have a personal doctor on staff and pay all my bills with gold bars, do I still have to pay for insurance or be given an additional "tax"?

I am also not really convinced it is a "tax". Seems to me that taxes are generally incurred by "doing something"(buying something / owning something) where as this is more of a fine/penalty for "not doing something", but I'm not really a law person : [

It also seems that since they ruled that states don't have to pay into the kiddy for people who can't afford HC that they will most definitely not have enough money to cover costs.

It seems to me that they are trying to force me to pay for health care coverage I don't need/won't use so they can take my money and pay for the old/royally fucked peoples HC in some kind of pyramid scheme thing : [

I am willing to assume that there are some good things in the bill(because there is so god damn much stuff in that bill something would have to be good) but I would rather the whole system gets rewritten rather then getting forced into using it : [

Help me understand and correct anything wrong I have said!

I agree with Chuba - and Weena.

The law is bad. It's not a tax because it doesn't tax anything, and it makes no sense because it's unenforceable. What are you going to do, throw people behind bars because they won't give a corp $300 a month?

This is a win for the HMOs - not the American people.

In fact I do not believe this is really even a healthcare law. I believe the actual purpose of this law is to criminalize the lives of political dissidents and the disenfranchised poor, who would in no event be inclined or able to get healthcare.

I'm okay with this decision.

Grats Obama.

Usdk, I'm sorry if you agree with that video, but fuck his phrasing. Food and healthcare are necessities, not commodities. Lobster bisque and several MRI scans are commodities. You have a right to walk this earth without a cleft pallet because we have healthcare. You should also have a right to something better than food stamps but that's another story.

I sincerely hate people that phrase politics like him.

You're going to fine them. That's where the "tax" comes in. Either you have coverage (and nothing changes) or your tax rate increases (penalty for not being in the insurance pool).

An increase in tax is not a fine. Or is it? What authority determines the exact penalties? Is violating the law a crime or a choice, like any other household management decision? Who defines what coverage is? And what if we get a whole host of similarly structured laws? A hundred such laws, say, in the next 20 years?

This is just bad.

I have a question. If someone who is "fit" and doesn't think they need health insurance gets in an accident and can't afford coverage, would an acceptable-to-republicans alternative be that it would be okay to turn away this individual like they do in Pakistan/India/etc? I wonder if republicans would take this option over Obamacare, with their individuals-are-awesome bravado thinking...?

EDIT: Actually, I think they would. As long as Obama's name is attached to it, it has to be bad and killed.

Of course, the implication here is that the other 8 simply voted with their blocs. So, "Grats, Roberts!"/"Shame on the rest of you!" 8)
