In both cases I thought it was an unequal treatment of the JW's that rules it was unconstitutional; one religion get's penalized while other's don't. If all religions were taxed equally (and treated more like companies), then there would be no religious preference by the government. I don't think all religious institutions getting taxed is unconstitutional. Tuhl?

It's tricky. If the tax can be somehow interpreted as an attack on free exercise of religion, it'll immediately get shot down. Because free exercise, for some reason, extends beyond the walls of a religious building.

At the same time, the law is capable of regulating religious practices (rites, for example. You're allowed to worship Tezcatlipoca, but you're not allowed to sacrifice people and offer up their hearts). Taxes are certainly regulations, but it would require a favorable bench to come out that way, and like most of you pointed out, that's political suicide (and grounds for a recall/impeachment if you're a judge).

So it's not necessarily unconstitutional, though it may certainly be found that way if someone tried to tax church property or something like that. No one's going to try.

The republican field is an absolute trainwreck. People may not be happy with the way the debt ceiling deal went down, but I can't see anyone in that clusterfuck that will beat Obama. Romney's still the best chance, but some of the shit he's said is going to come back to bite him.

I wouldn't be that confident of Obama's ability to win the upcoming election. The black caucus, democrats (like those campaigning), and progressives aren't very happy with the president because he hasn't delivered. Even with a weak Republican field (Front-runners Bachman, Romney, Paul and Perry), I think the only thing that could secure a re-election would be an upturn in the economy. The economy isn't likely to rebound in 1 1/2 years and people now see the President for what he is... which isn't much at all. Even his waning popularity of a crutch isn't likely enough to save him.

Unless a republican messiah materializes out of thin air, the best they can put up against Obama is someone painfully out of touch while trying to act like just one of the guys ("I'm unemployed too!" says the multimillionaire. "Corporations are people!"). The rest of the 'front-runners' include two religious nut-jobs, one of whom has done even less than Obama when he was running, and one who has spent since 2000 turning Texas into the embarrassment of the country it is now. Ron Paul has no shot, period. All you'd have to do is show the absolute decimation of the American society that would occur from his stated aim of destroying the government and people would flock to Obama even if they didn't like him. He will get no support from the system (which has happened every time he's run), and without that he's dead in the water.

Usd's right, Obama only has to worry about not looking insane, the republicans are just going to scare votes his way.

Ron paul would have a decent shot if the right side of the media was on his side, unfortunately they're just ignoring him completely.

and paul does have some good ideas, even if he tries to take them a bit far.
