An idea was taking shape in my head about how to potentially fix the legal system - specifically, the inequities of wealth/time that legal fees create, balancing the system in favor of corporations with lawyers on retainer and frivolous high-yield personal injury and class action suits.

What if the legal practice was put on a DKP system?

All cases go through the bar association as a sort of clearinghouse. Attorneys bid on cases. The outcome and value of the case determine the score awarded by its resolution (this also creates an incentive for efficient justice). To ensure that low-value cases don't languish, and that attorneys at the bottom of the pole get a fair chance, there is a point multiplier that scales inversely with the DKP value of the case. High-DKP cases award a lot of points and prestige, but with less variance between a win and a loss, low-DKP cases are more difficult/undesirable, but offer greater rewards if won.

Pay grade and seniority would be determined by lifetime DKP. To prevent hoarding and washouts, there would be decay (just like in any good DKP system) as well as a fixed monthly DKP allowance on top of all earnings (to mitigate risk).

Essentially, the system is a cross between horse racing and a PvP ladder.

The benefit of the system, in theory, is that all would receive equal access to the law, based purely on the merits of their case.

Which costs more, a public defender or a private attorney?

Regardless of where the money used to pay comes from, I take issue with government in general paying exorbitant amounts of money to pay for the defense of retards like Casey Anthony and OJ..which would be inevitable under your system.

even the guilty have a right to a fair trial, sorry. if you change the system for the ones who are innocent, it has to change for the ones who are guilty too.

1) I don't want laywers bidding for my case; I want to choose which lawyer I want to represent me based on their past performance. Not all lawyers are of equal quality. Some are better than others and depending on the case I'd want the best my budget could buy.

2) I'm sure there are people who've never needed a lawyer or had to pay legal fees (except with house closing and crap like that)... so why should their taxes pay for my legal representation? People need attorney's for anything like parking violations, bankruptcy, divorce, murder, theft, extortion, civil and domestic disputes, etc. If I'm on trial for any of the above, random strangers shouldn't be fronting any part of the bill.

Though then you get guys like the case I almost sat on where the guy was caught on tape and by CHP drunk off of his ass breaking shit. He elected to go through the trial knowing he had no chance of winning.

I figure you'd still retain the ability to have your pick. This would be for public defenders, or should be.

This would be added bureaucracy, which as a general rule I'm in favor of because it's artificial job creation.

It probably wouldn't be any more efficient, though it might be a bit more fair.
