Nothing gives me the right, legalwise. But I haven't harmed the seller. The opposite is likely to be true. I'm more eager to buy a game I know I like and is worth my money, than one I know next to nothing about.

It isn't even remotely close to eminent domain. Eminent domain involves the buyer setting the price, and it involves the actual taking of something. I'm taking a copy, and then paying the seller's asking price.

I'm sorry my facetiousness didn't translate with the written word. My words were very uncertain in tone for a reason.

Since the seller is running a business, and the rational purpose of a business is to maximize profit, and successful businesses are rational - so the libertarian argument goes - then what is your basis for second-guessing their business strategy other than a lack of faith in the free market itself?

Haven't you hurt them by:
1. the cost of having to impose DRM (and the annoyance this causes everyone else)
2. the cost of your ISP mailing you a CnD because they felt it was necessary
3. the opportunity cost of charging for trials etc
4. violated their freedom, security and honor by going against their lawful wishes regarding the property and value they created

Intellectual property is property. It's no different than some guy borrowing your car or clothes without permission then pointing out that no lasting damage was done.

You're rationalizing. It definitely hurts the seller if you are taking a product that they spent money to create, and also depriving them of the revenue.

You can say you are more likely to play a game....then why not play demos? Why steal the game?

Don't sugar coat it if you download something illegally. It is what it is. You want the product, but don't want to pay for it. I wouldn't blame you, I don't like paying for things either. Just call it what it is.

because most games now don't have a demo. not that it would do any amount of good in the pool of games that take 3 hours to finish, because the demo would be 5 minutes tops as to not spoil the rest of the game.

60 bucks for some 3-5 hour "game" that is more cutscenes and quicktime events (see: shit that makes you not in control of your character in a VIDEO GAME. GAME.) doesn't warrant 60 bucks ever. PRESS A BUTTON AND SOMETHING AWESOME HAPPENS is cool every so often. not the majority of the "gameplay"

1:37-1:53 sums up everything wrong right now.

It is their property, it is their choice. They made it, they do what they want with it.

So the libertarian argument goes.

Except I end up paying for the majority of them, and the ones that aren't paid for are depriving anybody of anything.

Buying preowned, renting or trading with someone is more depriving of the owners than anything I do.

Amazing how this was intended to bring about discussion about the comparison of petty theft and pirating and the discrepancy in their fines. But almost instantly turned into people (some sounding bitter) failing in an attempt to point out some kind of hypocrisy.

But please, continue with this convoluted reasoning that paying for something is harmful and/or theft.

Renting games to try them out and possibly buy them later.

Except renting implies mutually agreed upon terms.

What you are doing is theft, no bullshit about it. The fine is excessive, but don't try to pretend it's not theft. If it quacks like a duck..

Really, asking the question, "How were they harmed?" is a red herring.

The question is irrelevant and meaningless. Whether they were "harmed" is not the point. What matters is, under free market/libertarian philosophy, it's their property, to manage as they please. No one is in a position to second-guess what the rightful owners do with their stuff.

I don't pirate games. I'm also not a capitalist.

What I do is look into games I might want to play. Space Marine had a demo. The demo was all it took to realize the game was fucking awesome. Other games have gameplay vids on youtube or shit like that.

I also honestly don't care if other people pirate. That's fine. I do think it's a little ironic when the pirates are the ones who love the free market and supposedly keep society running with their dollars (that they don't spend because lolpirates).

I don't care if other people pirate either, just like i don't care if people speed or drink underage.

It's illegal sure, but as long as it doesn't affect me, let them take the risk. I'm a big fan of risk taking, as long as the juice is worth the squeeze.
