I'm signing into a service provided by a company and the representatives for the company were at my house until 10:30 on Wednesday night. One of the things I was told is there is a "lifetime warranty" on the service. I signed the contract knowing I have three days in the state of Virginia to rescind the contract, so there was no harm in signing.

The following day I read the entirety of the five page contract and I didn't see any mention of the "Lifetime Warranty", but instead I read about an "Extended Limited Warranty/QSP (Quality Service Plan)", and in the section regarding that, it says that I have to purchase that service.

My contract had no indication that I had purchased that extended service plan since the check box wasn't checked. Instead, it's saying that I'm purchasing a "BUN-GSM", or "GSM Bundle". I contacted customer service and asked that they send me documentation stating what's in the "BUN-GSM"... simply, if one of the items rolled into that bundle is the QSP then I think I'm fine. Well, they were telling me three different things.

First, I was told they couldn't send me the information.
Then, I was told they could send me the information, but they haven't yet.
Lastly, I was told by the rep that visited my house, "There isn't anything that explicitly states what's in the bundle... it's just a pricing package that we use." He then admitted that he didn't check the check box stating I was getting the extended warranty.

I called customer service back and said that if this issue isn't resolved before setup that I wouldn't get the service and I'd just rescind my contract. I think we have two avenues of resolution...

1) The customer service representative sent me an e-mail saying that the BUN-GSM includes the Extended Service Plan. My contract says I'm buying the BUN-GSM and I have an e-mail saying it's included in the BUN-GSM, but I'm concerned that the checkbox isn't checked on the contract.

2) We modify both copies of the contract; mine and theirs. I'm thinking that if I check the checkbox on the contract, then the technician and I both initial and date the change. Then he can take his copy back to the office.

So, now you get to tell me your opinions.

* Is the e-mail/contract combination in the first enough proof?
* Is the change to the contract in the second a better alternative? Is this a legal and acceptable way of making the change? Is there something else that I need to do?
* If the second process is most preferred, but they bring a carbon or photocopy of the contract, then what? Couldn't they just toss the copy out, maintain the un-altered original and then pretend like I never got the extended warranty?

Thoughts?

My first thought is that this is ironic on so many levels it's hilarious.

Second thought is that making a point of not specifying what you bought but providing a term that can be Googled to find out is silly.

Third thought is that the first hit on Google is the commission schedule from the vendor.

Fourth thought is that navigating to the root URL automatically redirects to a login screen.

Fifth thought is that instead navigating to the subdirectory of the first hit, instead of the login screen, yields, besides a commission schedule, a series of lists of chargebacks the vendor has been hit with each month. With the full names of the customers included.

Sixth thought is the irony that this vendor sells security products yet their site can be hacked for personal info and internal information by someone with zero programming knowledge.

Seventh thought is that you don't really have proof of anything because all the services you have "proof" you purchased don't mean anything other than what the company says they do.

Eighth thought is that your VA "right to rescind" means nothing because they will simply stonewall until time runs out.

Ninth and final thought is that you'll probably simply have to file a chargeback/small claims court suit like all the other losers fearmongered into buying their useless and overpriced products.

this.

EDIT: when I finally have to worry about stuff like this (and finances), I hope I can be more like you and be willing to read the entirety of a contract and all the fine print. Oh and disciplined with my money. Still gotta have a sit-down about that one.

The secret is to discover that scrounging, haggling, kitbashing, clearance hoarding, eBay churning and other forms of contrived thrift are more fun than actually acquiring things.
