So the Supreme Court handed down a decisions today, but not on gay marriage. The decisions in Florida v. Jardines holds that the act of bringing a police dog onto someone's porch and having it sniff for drugs constituted a "search." Scalia, Thomas, Kagan, Ginsburg, Sotomayer joined in the majority opinion. Alito, Roberts, Kennedy, and Breyer joined in the dissenting opinion.

Alito is becoming more of a disappointment with every decision.

If you really want to see weird court splits, read any case involving the Confrontation Clause.

And USD, thanks to this decision, bringing the dog is a search so you get Fourth Amendment protection.

This is good, because a couple weeks ago, a cop banged on my door and asked if I was "Ok, owing to that I hadn't gotten my mail in two weeks."

He had a dog with him, not sure if drug dog, but it lost its shit when I opened the door (I grow my own medicine), and the cop said that was weird and asked if he could take a look around. I said, "Not without a warrant, sir."

Moved plant + extraneous materials. Next week he comes back with a warrant, friends and dog, looks around, dog going crazy about my closet, which had nothing in it. Says to his friend under his breath, "This closet is tiny, can't be our guy." Looks at my purple heart on the wall, tells me he used to be in the Navy, thanks me for service, tells me, "Just be careful, distribution is a bad idea."

"Distribution of what?" I say.

Dog still losing its shit, they smile, shake my hand and leave.

I was so fucking weirded out.


Verily, I have often laughed at weaklings who thought themselves proud because they had no claws.

You handled that well. Glad they weren't dick cops though. How long is a search warrant valid?

Yeah thankfully my area is a hippie oasis. I don't know about the search warrants though, Tuhl will have to weigh in on that. I think once the search is finished the warrant becomes null. Although there could be all kinds of types of warrants. Now you got me paranoid, man.

Scratch that, I've just got my one plant. They aren't gonna throw up any roadblocks for an old crook like me.
