The way the court report reads; the graduate student witnessed the sexual assault occur, informed his father, and they then both went to Joe Paterno's house and informed him. The grand jury has cited the graduate assistants testimony as "extremely credible." It's also important to note that the accused pedophile had similar allegations in years previous (that Joe Paterno was aware of) but no official charges were filed.
I think it's a question of, did Joe Paterno do enough? He informed his university president and AD the very next day and they said that they would investigate. Well, they didn't investigate or inform the police, which is why they are now facing charges for failure to report the crime and lying to a grand jury (they lied about their knowledge of the situation).
I feel like if anyone ever brought something like this to me ("hey I just witnessed this guy who works for you banging a kid in the ass") I would inform my superiors, but I would also FOLLOW UP with them. You have to think of the welfare of the children in this case and it's a "better safe than sorry" Tell the cops so they can investigate.
The worst thing about all this is that the pedophile was still allowed access to all Penn State facilities until just this week. In fact, he had been around their athletic facilities as recently as last week...and this all happened a decade ago. It's no secret that the accused and Joe Pa were close friends (he was the defensive coach for 30 years, and part of 2 national championship teams...he was for a time considered the head coach in waiting after Paterno decided to hang them up).
Part of me wants to give Joe Paterno the benefit of the doubt...he did what he was supposed to, he told his superiors. Still...is that the kind of thing you just tell your superior and never follow up on? Perhaps following up could have revealed some inconvenient truths about the lack of action?
